Department of Homeland Security Announces New Immigration Enforcement Directive for Certain Children

On June 15, 2012, U.S. Department of Homeland Security Secretary Janet Napolitano announced that effective immediately, certain young people who were brought to the United States as young children, do not present a risk to national security or public safety, and meet several key criteria will be considered for relief from removal from the country or from entering into removal proceedings. Those who demonstrate that they meet the following criteria will be eligible on a case by case basis to receive deferred action for a period of two years, subject to renewal, and will be eligible to apply for work authorization:

• Came to the United States under the age of 16
• Have continuously resided in the United States for at least 5 years preceding the date of this directive and are present in the United States on the date of the directive
• Are currently in school, have graduated from high school, have obtained a general education development certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States
• Have not been convicted of a felony offense, a significant misdemeanor offense, multiple misdemeanor offenses, or otherwise pose a threat to national security or public safety
• Are not above the age of 30

 
The new directive will be implemented in the coming weeks, and the U.S. Citizenship and Immigration Services (USCIS) will outline and announce the procedures by which individuals can engage in this process. Urban League affiliates who have constituents that may be impacted by this new directive and want to provide additional information should have the impacted individuals contact the following resources:

• Effective June 18, 2012, individuals may call the USCIS hotline at 1-800-375-5283, from 8:00am to 8:00pm, with questions or to request more information (in English and Spanish); or visit the USCIS website.
• Individuals who are in the middle of removal proceedings before the Executive Office for Immigration Review can obtain additional information from the ICE Office of the Public Advocate, and effective June 18, 2012 can call the ICE hotline at 1-888-351-4024, from 9:00am to 5:pm.
